The president of La Liga asked for a rectification of the story they published accusing him of giving fake evidence over Caso Negreira

Javier Tebas sent a letter to La Vanguardia newspaper asking for a rectification, after they claimed he provided fake evidence over the Negreira case.

This is that burofax:

"Dear Mr. Raja:

Madrid, 3 April 2023

I am writing to you in your capacity as Director of La Vanguardia, in relation to the article published in this media outlet on 3 April 2023, at 01:00 hours, entitled "Tebas provided the Public Prosecutor's Office with false evidence against Barça"", authored by Mr Manel Pérez and Mr Toni Muñoz and accessible at the following URL: https://www.lavanguardia.com/deportes/fc- barcelona/20230403/8873299/tebas-aporto-fiscalia-prueba-falsa-barca.html

La Vanguardia has published this news item in its paper edition and on the digital front page of La Vanguardia https://www.lavanguardia.com/, occupying in both cases the lead headlines of the newspaper. The article has also been disseminated, at least through its official Twitter profile (@LaVanguardia).

The information disseminated in this article includes assertions and erroneous information, lacking evidentiary support and which, misrepresented as they are, seriously damage my honour and reputation, as well as the image of the Liga Nacional de Fútbol Profesional ("LaLiga"), the association over which I preside and in whose name and on whose behalf I am sending you this communication, a damage that has been considerably aggravated by the social media repercussion of this news item.

In particular, we must emphasise that La Vanguardia, through the headline, falsely accuses me of having provided false evidence in the investigation proceedings of the Public Prosecutor's Office against FC Barcelona, when in its own letter in which it bases this statement, it clearly denies it.

In this regard, as analysed in the aforementioned letter, the institution that I preside is a private prosecutor in the preliminary proceedings 35/2017 of the Central Court of Instruction No. 1 of the National High Court (known as the "Soule Case"), proceedings in which Mr. José Contreras was under investigation, having noted the existence of a false accusation in the preliminary proceedings against FC Barcelona. José Contreras, having noted the existence of said proceedings, the existence of a series of relevant documentation for the result of the investigation proceedings that the Barcelona Prosecutor's Office was processing in relation to the Negreira Case, which is why, by means of a letter, the contribution of the same was made to the Provincial Prosecutor's Office of Barcelona.

In the letter itself, each of the different documents that were being objectively provided were described, among which was the aforementioned handwritten document, clarifying in this description that:

"On the first page of this handwritten note there is a list of what appears to be more than twenty properties, on the second page there are a series of annotations concerning names, surnames and what appear to be financial institutions and investment banks.”

In order to avoid misunderstandings, a cut of the second page of the aforementioned handwritten note is included below, in which the aforementioned points can be seen at a glance. All this with the utmost transparency and objectivity, adding furthermore that:"Neither this party has any speculative intent, nor does the present document imply the exercise of any specific accusation against anyone".

This is why we are far from false evidence (which could constitute a crime, meaning that the article in your newspaper would have slandered me), as it forms part of criminal proceedings, nor does the document represent an accusation against anyone, as stated in the document itself submitted to the Barcelona Public Prosecutor's Office. The headline of your article implies information that does not correspond to reality.

It is for this reason that, in accordance with the provisions of Law 2/1984, of 26 March, regulating the Right of Rectification, I expressly and formally request you to publish within a maximum period of 3 calendar days from receipt of this letter, in the same exact location in which the incorrect article was published and with similar relevance and dissemination to that in which the article was published - including the official account of "La Vanguardia" on the social networks Twitter, Facebook, as well as any other in which the article has been published - the rectification attached below.

Likewise, I expressly request you to proceed, in application of the provisions of art. 85.2 of Organic Law 3/2018, of 5 December, on the protection of personal data and guarantee of digital rights, to publish the explanatory notice referred to in the aforementioned article, i.e., stating that the original news item has been subject to rectification in a visible place and together with the original information.

The aforementioned "RECTIFICATION" must be published without comments or apostilles, and the following expression must also appear in the heading:

"Rectification requested by Mr. Javier Tebas Medrano regarding the article 'Tebas provided the Prosecutor's Office with false evidence against Barça"'.

In relation to the article published on 3 April 2023 in this media outlet under the title 'Tebas provided the Public Prosecutor's Office with false evidence against Barça', authored by Mr Manel Pérez and Mr Toni Muñoz, Mr Javier Tebas Medrano wishes to state the following:

1. It is not true that Mr Javier Tebas Medrano has provided the Barcelona Provincial Prosecutor's Office with any false documentation, neither against FC Barcelona, nor against any of its former executives or directors.

2. “La Vanguardia", through the article headline, falsely accuses me of having provided false evidence in criminal proceedings against FC Barcelona, which is slanderous information, especially when in the body of the letter upon which it bases this statement it is clearly denied.

3. In this regard, as analysed in the aforementioned letter (and it is therefore known to the authors of the news item and the media itself), the institution I preside over is a private prosecutor in the preliminary proceedings 35/2017 of the Central Court of Instruction No. 1 of the National High Court (known as the "Soule Case"), proceedings in which Mr. José Contreras was under investigation. José Contreras, having noted the existence of said proceedings the existence of a series of relevant documentation for the result of the investigation proceedings that the Prosecutor's Office of Barcelona was processing in relation to the Negreira Case, which is the reason why, by means of a letter, and there being legitimate cause to do so, the contribution of the same was made to the Provincial Prosecutor's Office of Barcelona for the purpose of the latter having all the factual and evidential elements possible before concluding its investigation proceedings.

The document itself describes with the utmost objectivity each of the different documents that were being provided, including the aforementioned handwritten document, clarifying in this description that: "On the first page of this handwritten note there is a list of what appears to be more than twenty

properties, on the second page there are a series of annotations concerning names, surnames and what appear to be financial institutions and investment banks".

Furthermore, in order to avoid misunderstandings, a cut of the second page of the aforementioned handwritten note was included in the document itself, in which the aforementioned points could be seen at a glance, adding that: "Neither this party has any speculative intent, nor does the present document imply the exercise of a specific accusation against anyone".

It is for this reason why we are far from false evidence, as it forms part of the proceedings of a criminal procedure, nor does the document represent an accusation against anyone, as stated in the document submitted to the Barcelona Public Prosecutor's Office. The headline implies the content of information that does not correspond to reality.

Without prejudice to the warning addressed to you to publish the above rectification within the period and in the manner indicated, both the undersigned and LaLiga expressly reserve the right to take any legal action that may correspond to them until the erroneous statements made in this regard have been corrected.
